⭐️ FILM TRIPS — GUEST TERMS OF SERVICE (U.S. & Territories Edition)

These Guest Terms of Service (“Terms”) form a legally binding contract between Film Trips, LLC (“Film Trips,” “we,” “our,” or “us”) and any individual who books, attends, or participates in a Film Trip (“Guest,” “you,” or “your”).

By creating an account, booking a Film Trip, or participating in one, you agree to these Terms, including the Liability Waiver, Assumption of Risk, Audio/Video Consent, and Arbitration provisions.

1. Overview of Film Trips

1.1 Marketplace Role.

Film Trips is a marketplace platform that connects Guests with independent content creators (“Creators,” “Hosts”). Film Trips does not operate, supervise, or manage Film Trips and is not present during any experiences.

1.2 Independent Creators.

Creators are independent contractors—not Film Trips employees, partners, or agents.

1.3 No Guarantee of Quality or Results.

Film Trips does not guarantee the quality, timing, delivery, or style of any content or experience.

2. Eligibility & Account Requirements

2.1 Minimum Age. Guests must be 18 or older.

2.2 Real Identity. Guests must provide accurate personal information.

2.3 Account Security. Guests are responsible for account activity.

3. Nationwide Applicability & Local Law Compliance

3.1 Applicability Across States & Territories.

These Terms apply in all U.S. states, D.C., and U.S. territories.

3.2 Local Law Variation.

Guests acknowledge that laws differ across jurisdictions, including:

  • Liability rules

  • Public filming rules

  • Consent laws

  • Premises liability

  • Park/permit requirements

Where a local law overrides any part of these Terms, the remaining sections remain enforceable.

3.3 Guest Responsibility.

Guests must comply with all local laws in the city/state/territory where the Film Trip occurs.

3.4 No Duty to Verify Compliance.

Film Trips does not check or verify compliance with local laws.

4. Guest Responsibilities & Conduct

Guests agree to:

Arrive on time

  • Follow Creator instructions

  • Behave respectfully

  • Not endanger themselves or others

  • Adhere to all venue and public space rules

  • Not harass, discriminate, or act inappropriately

  • Respect all equipment, venues, and public property

Prohibited behaviors include:

  • Intoxication or illegal substances

  • Harassment or discrimination

  • Violating consent or privacy laws

  • Damaging property

  • Bringing weapons

  • Disrupting the Film Trip

Film Trips may remove guests for misconduct.

5. Assumption of Risk & Liability Waiver (Nationwide)

By booking or attending a Film Trip, you VOLUNTARILY assume ALL risks associated with participating in outdoor and indoor activities, including but not limited to:

  • Weather (heat, rain, lightning)

  • Wildlife, insects, water, sand, rocks, uneven terrain

  • Crowds, vehicles, bicycles, public hazards

  • Slips, trips, collisions, falls

  • Indoor hazards (equipment, studio gear, floors)

  • Acts or omissions of the Creator or other Guests

  • Equipment failure

  • Being photographed/recorded in public

Film Trips is NOT responsible for your safety during Film Trips.

6. Indoor Locations & Venue Liability

Some Film Trips take place inside commercial venues such as studios, galleries, coworking spaces, rental locations, or more.

Guests acknowledge:

  • Film Trips does NOT own, operate, manage, or control these venues

  • Venue hazards (floors, lighting, equipment) are inherent

  • Guests must follow venue rules

  • Film Trips is NOT liable for injuries, incidents, or property loss inside indoor venues

7. Nationwide Audio/Video Consent (One-Party & Two-Party States)

By booking or attending a Film Trip, you provide EXPRESS consent to:

  • Being photographed

  • Being filmed

  • Being recorded (audio and video)

  • Being included in group footage

This consent applies in ALL U.S. states — including two-party consent states such as:

  • Florida

  • Pennsylvania

  • California

  • Washington

  • Maryland

  • Illinois

  • Massachusetts

  • Montana

Creators may capture footage, and Guests waive any claims related to public recording.

8. Content Delivery & Usage Rights

8.1 Creator Responsible for Delivery.

Film Trips has no involvement in content delivery.

8.2 No Guarantees.

Film Trips does not guarantee:

  • Quality

  • Editing style

  • Delivery timing

  • Number of images

  • Specific results

8.3 Guest Usage Rights.

Guests receive personal use rights only.

8.4 Creator Portfolio Rights.

Creators may use content featuring Guests unless the Guest requests removal in writing.

8.5 Film Trips Marketing Rights (Limited).

Film Trips may use sample images for platform promotion unless revoked by email.

9. Cancellations, Refunds & No-Show Policy

9.1 Guest cancellations follow the policy shown at checkout.

9.2 If the Creator cancels, Guests receive a full refund.

9.3 Weather alone does not guarantee a refund unless conditions are unsafe.

9.4 Arriving 15 minutes late may count as a no-show. No-shows are non-refundable.

10. No Transportation Provided

Guests are solely responsible for transportation to and from the Film Trip.

Film Trips and Creators do not provide rides or arrange transportation.

11. Disclaimers & Limitation of Liability

To the fullest extent permitted by law:

  • Film Trips is not liable for injuries, damages, misconduct, accidents, or losses

  • Film Trips does not insure Guests or Creators

  • Film Trips does not inspect locations

  • Film Trips does not provide safety advice

  • Participation is voluntary and at the Guest’s own risk

12. Indemnification

Guests agree to defend, indemnify, and hold Film Trips harmless from any claims arising from:

  • Their actions or negligence

  • Violations of these Terms

  • Interactions with Creators or other Guests

  • Activities during the Film Trip

  • Venue or public space incidents

13. Binding Arbitration & Governing Law

13.1 Mandatory Arbitration.

All disputes shall be resolved through binding arbitration, not court.

13.2 Exclusive Venue.

Arbitration must take place in Florida, regardless of where the Film Trip occurred.

13.3 Governing Law.

Florida law governs these Terms.

13.4 Class Action Waiver.

Guests waive the right to participate in class actions.

14. Updates to Terms

Film Trips may update these Terms at any time. Continued use constitutes acceptance.

15. Digital Acceptance

  • By booking, attending, or creating an account, Guests agree that:

  • These Terms form a legally binding contract

  • They assume all risks

  • They consent to photography, filming, and recording

  • They release Film Trips from liability

  • They accept all disclaimers and limitations
