FILM TRIPS — CREATOR HOST AGREEMENT (U.S. & Territories Edition)
Effective Date: 11-30-2025
This Agreement is between Film Trips, LLC (“Film Trips”) and the independent creator (“Creator” or “Host”).
By creating an account, applying as a Creator, publishing a listing, or hosting any Film Trip, Creator agrees to the terms below.
1. Eligibility, Identity & Account Requirements
1.1 Minimum Age. Creator must be 18+ to create an account or host any Film Trips.
1.2 Use of Legal Identity. Creator must provide accurate legal identity information. Film Trips may require ID verification at any time.
1.3 Independent Contractor. Creator is an independent contractor, not an employee, agent, or partner of Film Trips. Creator is solely responsible for taxes, insurance, and compliance with federal, state, territorial, and local laws.
1.4 Account Security. Creator is responsible for all actions taken through their account.
2. Nature of the Platform
2.1 Marketplace Only. Film Trips is a marketplace platform connecting guests with independent Creators. The platform does not host, manage, supervise, or operate Film Trips.
2.2 No Control Over Creator Services. Creator has full discretion in how they design, lead, and operate their Film Trips.
2.3 No Employment Relationship. This Agreement does not create an employment, partnership, joint venture, or agency relationship.
2.4 No Guarantee of Income. Film Trips provides no guarantee of bookings, income, visibility, or audience growth.
2.5 No Duty to Monitor Compliance. Film Trips does not monitor Creator compliance with local laws or permits; Creator is solely responsible.
3. Multi-State & Multi-Territory Operations
3.1 Applicability Across All Jurisdictions. This Agreement applies to all Film Trips conducted in all U.S. states, the District of Columbia, and U.S. territories.
3.2 State & Territory Variations. Liability laws, consent laws, premises liability, and consumer protections vary by state and territory. Creator agrees that:
Film Trips’ Terms apply regardless of jurisdiction, and
Any section rendered unenforceable in one jurisdiction remains enforceable everywhere else.
3.3 Creator Responsible for Local Laws. Creator must comply with all local regulations, including:
Permits
Park rules
Commercial photography rules
Venue regulations
Insurance requirements specific to some states
Drone/FAA rules (if applicable)
3.4 No Duty to Verify Local Compliance. Film Trips is not responsible for ensuring Creator compliance with any local, state, or territorial laws.
4. Safety, Conduct & Location Requirements
4.1 Public Locations (Default)
Film Trips must be hosted in public or semi-public areas such as parks, beaches, streets, markets, and community spaces unless Section 4.2 applies.
4.2 Indoor Locations — Special Conditions
Indoor hosting is allowed only if the venue is:
A commercially operated space
A studio, coworking space, gallery, or rental venue (including Peerspace-type rentals)
Insured by the venue owner
Not a private residence, personal home studio, hotel room, or unregulated indoor location
Creator takes full responsibility for indoor venues, including:
Renting or securing permission
Following venue rules
Assessing safety
Preventing hazards
Managing guests inside the space
Any injuries, accidents, or property damage
Film Trips is not the renter, owner, operator, or manager of the venue.
4.3 No Transportation
Creator may not transport Guests or arrange transportation.
4.4 Safety Responsibilities
Creator must:
Assess weather, terrain, surfaces, crowds, and environmental risks
Monitor group safety
Cease activity in unsafe conditions
4.5 Prohibited Conduct
Creator may not:
Use weapons, illegal substances, or alcohol while hosting
Harass, discriminate, or violate civil rights protections
Host in unsafe or restricted zones
Misrepresent services
Give medical, legal, or safety advice
4.6 Emergency Response
Creator must contact emergency services in emergencies and report incidents to Film Trips within 24 hours.
5. Hosting Responsibilities
5.1 Provide accurate description of the Film Trip
5.2 Respond promptly to guest questions
5.3 Arrive 10 minutes early
5.4 Lead and manage the group responsibly
5.5 Maintain professional communication and conduct
5.6 Ensure Film Trip activities are legal in chosen location
6. Content Creation, Ownership & Delivery
6.1 Creator Owns All Content. Creator retains full copyright to all photos/videos created during Film Trips.
6.2 Guest Consent. Guests consent to being photographed/filmed by booking a Film Trip.
6.3 Delivery Responsibility. Creator is solely responsible for delivering content and maintaining backups. Film Trips is not liable for:
Lost files
Missed deadlines
Quality disputes
Editing choices
6.4 Guest Usage Rights. Creator grants guests a personal-use license only.
6.5 Creator Portfolio Rights. Creator may use images of guests for their portfolio unless guest revokes permission.
6.6 Film Trips Marketing License. Creator grants Film Trips a non-exclusive, revocable license to use sample content for platform marketing.
7. Prohibited Actions
Creator may not:
Accept or request off-platform payments
Solicit Film Trips guests for private sessions for 6 months
Circumvent Film Trips’ fees
Host Film Trips that violate venue or city rules
Misuse guest images commercially
8. Payments, Fees & Cancellations
8.1 Platform Fee. Film Trips keeps a 25% fee per booking.
8.2 Chargebacks. Film Trips may reverse Creator payouts if a payment is disputed.
8.3 All Transactions On-Platform. All communication and payments must occur on the Film Trips platform.
8.4 Refunds. Creator must follow the Film Trips cancellation and refund policy.
8.5 Tax Responsibility. Creator is solely responsible for all federal, state, territorial, and local taxes.
9. Liability, Assumption of Risk & Indemnification
9.1 Assumption of Risk (Nationwide)
Creator knowingly assumes all risks associated with hosting, including:
Weather
Terrain
Slippery or uneven surfaces
Crowds
Wildlife
Venue hazards
Equipment failure
Actions of guests or third parties
9.2 No Duty of Care
Film Trips does not inspect locations, supervise Film Trips, or provide safety services.
9.3 Creator Liability
Creator is fully responsible for:
All guest injuries
Property damage
Venue-related incidents
Safety hazards
Misconduct or negligence
9.4 Indemnification
Creator agrees to defend, indemnify, and hold Film Trips harmless from any claims, injuries, damages, lawsuits, or liabilities arising from the Creator’s actions or Film Trip operations.
9.5 No Warranties
Film Trips disclaims all implied warranties related to safety, profitability, or outcomes.
10. Multi-State Audio/Video Consent
Creator agrees that:
Guests consent to audio/video recording regardless of state law
Creator must comply with all consent laws in the state or territory where they operate
Film Trips is not responsible for violations of state recording laws
This covers one-party and two-party consent states.
11. Dispute Resolution, Governing Law & Arbitration
11.1 Mandatory Arbitration (National). All disputes must be resolved through binding arbitration.
11.2 Exclusive Venue (Florida). Arbitration must take place in the State of Florida, regardless of where the Film Trip occurred.
11.3 Governing Law. Florida law governs this Agreement.
11.4 No Class Actions. Creator waives the right to participate in class-action litigation.
11.5 Severability. Invalid provisions do not void the rest of the Agreement.
12. Digital Acceptance

This Agreement is legally binding
They understand all terms and risks
They assume full responsibility for their Film Trips
Continued use means continued acceptance
